Section A

Note: Attempt all questions. Each question carries 4 marks

1. What do you understand by the term ‘Dominant’ and ‘Servient’ Heritage?

2. What is easement by prescription?

3. Define exchange.

4. Define onerous gift.

5. Distinction between charge and mortgage.

Section B

Note: Attempt any two questions. Each question carries 10 marks

6. A mails a bank draft of Rs. 50,000 to B, his son as a gift. B in return writes a letter to A accepting the gift. Before B posts it he dies. Whether the gift is valid? Would it make any difference if A dies instead?

7. A is the owner of a land of which B is wrongfully in possession. A assigns his right to sue for mesne profit to C. Is the transfer valid? Can a right to sue be transferred?

8. Distinguish mortgage with charge and lease.

Note: Attempt any three questions. Each question carries 20 marks

9. Transferrability is the inherent quality of property.’ Explain what are the exceptions to this rule.

10. What is subrogation? What are its kinds? Who can claim subrogation? Distinguish between legal and conventional subrogation.

11. Define lease and explain its essential elements. Distinguish it form license and easement. When does a lease determined and forfeited?
